Privacy Notice

Jersey Opera House Limited, trading as Jersey Opera House, referred to as ‘we’ or ‘our’, is committed to protecting the privacy and security of your personal customer/supporter information.

This Privacy Notice describes how we collect and use personal information about you during and after your relationship with us pursuant to the Data Protection (Jersey) Law 2018 (“DPJL”).

Jersey Opera House is a “Data Controller”, which means we are responsible for deciding how we hold and use personal information. We are also registered with the Jersey Office of the Information Commissioner (“JOIC”) Registration No. 65170.

Jersey Opera House Limited (JOHL) is a registered charity and not-for-profit organisation funded by the Government of Jersey, donors, and supporters. Our NPO number is 00994, and our charity registration number is 60. We are registered under company number 71063 with the Jersey Financial Services Commission.

We will comply with the DPJL, the principles of which state that the personal information we hold about you must be: –
•Used lawfully, fairly and in a transparent way.
•Collected only for valid purposes that we have clearly explained to you and not used in any way incompatible with those purposes.
•Relevant to the purposes we have told you about and limited only to those purposes.
•Accurate and kept up to date.
•Kept your data only as long as necessary for the purposes we collected it.
•Kept securely.

Jersey Opera House must demonstrate compliance with the DPJL to both you and the authorities.

The Kind of Information We Hold About You

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We list our different services when we collect or use additional information about you.

How is Your Personal Information Collected When You Contact or Engage Our Services?

We collect personal customer/supporter information when you contact us and when you register to attend one of our events. We also collect customer/supporter information when you provide your details for a specific purpose, including enquiries, suggestions, comments, or complaints.

Photography, Filming, and Press Coverage

At times, press, photographers, or videographers engaged by us or acting as third-party contractors may be on site to capture images or video of events or activities at the Jersey Opera House. These third parties may retain rights to the content they create and may make it available in an online gallery or similar platform for patrons or performers to view and optionally purchase.

What Special Category Data do we collect about you?

Jersey Opera House do not collect Special Category data from clients unless it forms part of a performance or venue booking. If that is the case, we will explain our legal basis for processing your data and your rights to withdraw consent, if that is the legal basis used at the time.

How Will We Use Information About You?

We will only use your personal information where permitted by applicable law. Most commonly, we will use personal information in the following circumstances:
•You have entered a Contract with us to provide you with a service; an example of this would be when you have purchased a ticket or hired the Jersey Opera House for a specific show for you.
•We need to comply with a Legal Obligation; an example of this would be when we must comply with a lawful authority to disclose information to a government department.
•Where it is necessary for our Legitimate Interests, we only share your details with third-party service providers if you choose to opt in when buying your tickets. We may also contact you about our own events and services that we think you’ll enjoy, but only when this is in your interests, and your rights are protected.

We may also use your personal information in the following situations:

•Where you have given your Consent to contact you for a specific purpose, such as to receive marketing material, such as the newsletter about Jersey Opera House and future events.

Change of purpose

We use your personal information for the purpose you gave it to us, and only for another closely related reason related to it. For instance, if you register for an event, we may use your details
to send you important updates about that event.

Should we need to use your personal information for an unrelated purpose, we will notify you and state the legal basis permitting such use.

Personal data will not be shared with third-party hirers or producers unless you have consented to such disclosure. Where applicable, Ticketsolve provides an opt-in option for third-party productions, which you may unsubscribe from at any time.

Sponsorship opportunities (including chair sponsorship) and fundraising activities may involve the collection of supplementary personal information, including customer/supporter due diligence (CDD) information where required.

Data Sharing

We do not disclose information obtained through your engagement with us without a lawful basis for doing so. However, we may share Personal Information where necessary to comply with applicable laws, regulations, court orders, or valid governmental or regulatory requests.

We use trusted third-party service providers (also known as Processors) to support the delivery of our services, such as providers of IT systems and infrastructure, cloud hosting, communications, ticketing and booking systems, payment processing, and professional advisory services.

All Processors act only on our documented instructions and are subject to appropriate contractual obligations to ensure that Personal Information is processed securely, confidentially, and in accordance with the Data Protection (Jersey) Law 2018 and Jersey GDPR. We do not permit Processors to use Personal Information for their own direct marketing purposes.

Where Personal Information is transferred to a Processor located outside Jersey, the United Kingdom, or the European Economic Area (EEA), we ensure that appropriate safeguards are in place to provide a level of protection equivalent to that required under Jersey data protection law.

We take appropriate technical and organisational measures to ensure that your privacy rights are respected and that your Personal Information is protected in accordance with the standards set by the Data Protection (Jersey) Law 2018.

Data Security

We have in place appropriate security measures to prevent your personal information from being accidentally lost, altered, disclosed, or accessed in an unauthorised way. In addition, we limit access to your personal information to those Staff, Agents, Contractors and other third parties on a need-to-know basis.

Personal information will only be processed in accordance with our strict instructions and will remain subject to a duty of confidentiality.

Procedures are in place to assess any suspected data security breach and notify you and any applicable regulator of a suspected breach where legally required.

Data Retention

Personal information will be retained for as long as necessary to fulfil the purposes it was collected for, including to satisfy any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the quantity, nature, sensitivity, and potential risk of harm from unauthorised use or disclosure of your data. The purposes for which we process your data can be achieved through alternative means and relevant legal requirements.

You can request our Data Retention Schedule from our DPO if required.

In some circumstances, we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Press, Media and Safeguarding

From time to time, accredited press or media representatives may attend the Jersey Opera House for the purpose of recording or reporting on events. To ensure the protection and privacy of all individuals, particularly children and vulnerable adults, the following applies:
•Media activity will be controlled, supervised and restricted to designated areas.
•Individuals will not be intentionally identifiable in press material without an appropriate lawful basis or consent (where required).
•Additional safeguarding measures will be applied at events involving children or vulnerable persons.
•Visitors may inform staff if they do not wish to be included in any images or recordings, and we will take reasonable steps to accommodate this, such as an approved lanyard or identification badge.
•Exclusion from photography and filming must be explicitly stated by signing a form, ticking a box, or providing a written or verbal statement, so that nothing is implied or assumed.

Audience Filming and Photography Restrictions

For safeguarding, privacy and security reasons:

•Audience filming, photography and audio recording are strictly prohibited during all performances.
•A preshow announcement will remind patrons that recording of any kind is not permitted due to safeguarding requirements.
•Staff may require individuals to cease recording and delete unauthorised images or footage.
•Failure to comply may result in removal from the venue in accordance with venue policy.

Use of Social Media

We may wish to share images or videos of the shows which have taken place (e.g., Facebook) to showcase our services. These images will not include any personal details, such as names or addresses.

We will only use such images with your consent, which you may provide when engaging our services. You have the right to withdraw your consent at any time by contacting our Data Protection Manager at [email protected]

We may also respond to any reviews you place on social media regarding our business. We will only use the information you have provided and will not disclose any additional personal details that you have already disclosed during this process.

Rights of Access, Correction, Erasure, and Restriction

The personal information we hold about you must be accurate and current.

Please keep us informed if your information changes during your relationship with us.

Under certain circumstances, by law, you have the right to:

•Request access to your personal information (commonly known as a “data subject access request”). This right entitles you to receive a copy of the personal information we hold about you and to ensure that its processing is compliant with the law.
•Request correction of the personal information that we hold about you. This right enables you to have any incomplete or inaccurate data we hold about you corrected.
•Request erasure of your personal information. This right allows you to request the deletion or removal of your personal data where there is no valid reason for us to continue processing it. You may also ask us to delete or remove your personal information if you have exercised your right to object to processing (see below).
•Object to processing your personal information where we rely on a legitimate interest (or those of a third party). There is something about your situation that makes you want to object to processing on this ground. You also have the right to object to the processing of your personal information for direct marketing purposes.
•Request the restriction of processing of your personal information. This right allows you to ask us to suspend the processing of your personal information, for example, if you need us to verify its accuracy or the basis for processing it.
•Request the transfer of your personal information to another party.

If you want to review, verify, correct or request the erasure of your personal information, object to the processing or request that we transfer a copy of your personal information to another

You will not have to pay a fee to access your personal information (or exercise any other rights). However, we may charge a reasonable fee if your access request is unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

How to request your information and what we may need from you

You can use the Data Subject Access Request (DSAR) form, available on our Cookie Banner or click here for direct access to our data governance platform. If you have any questions about this process or any of your rights, contact our DPO at Jersey Opera House.

You can also email or verbally request a DSAR form from one of our team members.

We will need to request specific information from you to help us confirm your identity and ensure your right to access the information (or exercise any of your other rights).

We will respond to your request without undue delay, but certainly within Four Weeks after satisfactory verification of your identity. We can apply an eight-week extension to this if, in some circumstances, the request is complex and cannot be answered in four weeks. If this is to happen, we will inform you as soon as possible.

Right to Withdraw Consent

In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time.

Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to unless we have another legitimate basis for doing so in law.

Changes to this Privacy Notice

We reserve the right to update this privacy notice at any time. We may also notify you in other ways from time to time about processing your personal information or request that you confirm the accuracy of the information held.

Complaints

We want to resolve any complaints you have about how we process your information. You have the right to complain to the JOIC about how we have used your data.
